Islamabad High Court IHC has refused to issue the stay order to ban the entry of the 500 cc heavy bikes on the motorways. The single member bench has made this decision.

IHC division bench was headed by Chief Justice Athar Minallah heard an appeal, which was filed against the decision of single member bench to give the permission to play of heavy motorbikes on the motorways. The National Motorways and Highways Police challenged this decision through the intra court appeal. They pleaded that the court should reverse the decision and do not give the permission of entry of the heavy bikes into motorways and the police have urged the court to stay the permission, which is granted by single bench till disposal of petition. The Chief Justice of IHC, Justice Athar Minallah has refused to issue the stay order against the decision and court will not issue appropriate order on petition on 22 January. He ordered that the Motorway police should prepare the Standard Operating Procedure SOP and give the permission after satisfaction and comply with SOP. He further ordered that the IG NM and HP have the powers to put ban on the entrance of heavy motorbikes into motorways. The counsel of petitioner argued that there are many countries in the world, which allow the heavy bikes on motorways. He gave the reference of Motorway Ordinance 2000 and there is no restriction to ban on the entry of bikes into motorways.


He said that Motorway Police allowed the heavy bikes to enter on Motorways in 2011 and the authority re-imposed ban in 2014. The Chief Justice noted that during last three years, the heavy bikes were allowed to ply on motorways and no accident was reported. The single member bench of IHC has allowed the 500 cc heavy bikes to travel on motorways.
